PARTICIPATION WAIVER, RELEASE & INDEMNITY AGREEMENT

1. Acknowledgement of risks

I acknowledge that participating in pickleball and associated activities at Dink &  DrivePickleball Club (“the Club”) involves inherent risks, including but not limited to: slips, trips or falls on indoor court surfaces; collisions with other players, balls, paddles or court equipment; muscular strain, joint injuries or other physical injuries caused by rapid changes of direction, jumping, twisting, or stretching; injuries arising from congested or high-intensity play (including open play and tournaments); risks associated with renting and using Club equipment; risks that cannot be completely eliminated despite reasonable safety precautions. I understand and accept these risks as a condition of participation.

2. Voluntary Participation & Health Declaration

I confirm that I am participating voluntarily and that I am physically capable of engaging safely in pickleball. I am responsible for monitoring my health, warming up appropriately, staying hydrated, and stopping play if I feel unwell or unsafe.

3. Release of Liability

To the fullest extent permitted under Victorian law, I release and discharge Dink  & Drive Pickleball Club Pty Ltd, its directors, staff, contractors, coaches, volunteers and agents from all liability for: personal injury; property damage;economic loss; medical or emergency expenses; any harm arising from my participation in activities or use of the Club’s facilities. This release applies whether the injury or loss arises from my actions, the actions of others, accidental incidents, or risks inherent to the sport of pickleball.

4. Indemnity

I agree to indemnify the Club from any claims, damages or costs (including legal fees) brought by third parties as a result of my conduct, breach of Club rules, or misuse of equipment or facilities.

5. Minors

Where a participant is under 18 years of age: a parent or legal guardian must sign this waiver on their behalf; the guardian accepts full responsibility for the minor’s safety and behaviour; minors must be actively supervised by their guardian, except when enrolled in a supervised Club-run program.

6. Equipment use & damage

I agree to use Club equipment responsibly and only for its intended purpose. Rental paddles damaged beyond ordinary wear and tear will incur a $50 charge. Only non-marking, indoor-appropriate court shoes are permitted on the courts. The Club reserves the right to refuse court entry if footwear is considered unsafe or damaging to the playing surface.

7. Media & Photography Consent

I consent to the Club taking photographs or video recordings during play, events or activities and using such media for marketing, promotional or social media purposes, without compensation. If I wish to withdraw this consent, I must do so  in writing. Withdrawal will apply only to future recordings.

8. Emergency medical treatment

I authorise the Club to provide or arrange basic first aid or emergency medical attention if required. I accept responsibility for all associated costs.

9. Digital Acceptance via play by point

I understand that accepting this waiver electronically through the Play by Point app constitutes my legal signature and agreement. I acknowledge that I have  read, understood and voluntarily agree to this waiver as a condition of participating at Dink & Drive Pickleball Club Pty Ltd.

Venue booking policies

1. Bookings, Cancellations & Refunds

  • Cancel more than 24 hours before the booking: a credit refund will be issued. Cancel within 24 hours: no credit or refund is provided. Club credit is issued for eligible cancellations made more than 24 hours in advance. If a booking made using club credit is cancelled again, the credit cannot be reissued.
  • Open Play, Social Sessions & Events - Cancellation within 24 hours or failure to attend results in no credit. No-shows may affect future booking privileges.
  • Tournaments, Clinics & Coaching - Cancellations more than 24 hours in advance receive a credit. Cancellations within 24 hours receive no credit. The Club may adjust event formats or division structures if necessary.
  • Players who remain on court beyond their allocated booking time may incur charges for the extra time used, calculated at the applicable member or non member court hire rate.
  • Each account may book a minimum of 60 minutes and a maximum of 120 minutes per court. A maximum of three court bookings is allowed per account per week. Consecutive bookings of two courts at the same time on the same day are not permitted.
  • Paddle hire - $5 per paddle. $10 for demo paddle.
  • A 2% technology fee applies to bookings paid via Stripe card transactions. This fee does not apply when paying by Club Credits. All advertised prices reflect the base booking cost before any card processing fees.
  • No club, league, or competition may be organised, promoted, or conducted at the venue without prior written approval from the Club Manager.

2. Check-in Requirements

All players must check in using Play by Point or at reception before entering the courts. Players cannot enter the courts until checked in.

3. Facility & Safety Rules

  • Footwear

    Only indoor, non-marking court shoes are permitted. Shoes that leave marks, scuff the surface or pose safety risks are not allowed. Staff may refuse court access if footwear is unsuitable.
  • Equipment

    Personal paddles are allowed. Rental paddles damaged beyond normal wear incur a $50 replacement fee. Damaged for demo paddle will be 30% off the RRP of the paddle price sold on site. Balls and equipment must be used responsibly.
  • Court Conduct

    Avoid running behind active courts. Report any wet patches, hazards or spills immediately.
  • Only water is allowed in the court. No food or other beverages are allowed inside.

4. Behaviour & Conduct

Dink & Drive Pickleball Club promotes a safe, inclusive and respectful environment.

  • Zero Tolerance Policy

    The Club strictly prohibits: aggressive or dangerous play; abusive, intimidating or offensive language; harassment, discrimination or bullying; throwing paddles or intentional property damage; playing while intoxicated or under the influence of  drugs; disrupting other players or staff.
  • Sportsmanship Expectations

    Make fair line calls. Resolve disagreements respectfully — replay the point if  unsure. Rotate on and off court promptly during open play. Treat staff instructions as final.
  • Consequences

    Depending on severity, consequences may include: warning; removal from session; suspension of booking privileges; permanent ban. No refunds or credits will be issued if a player is removed due to misconduct.

5. Minors at the venue

Minors must be supervised by a parent or guardian unless in a Club-run junior program. Guardians are responsible for the behaviour and safety of minors at all times.

6. Amenities Use

Players’ Lounge: respectful use required; no disruptive behaviour.

Pro Shop: sales are final unless required by Australian Consumer Law.

Change Rooms & Toilets: keep clean; report issues to staff.

7. Photography & Filmiing

The Club may take photos and videos for promotional use. Players may record their own matches if: recordings do not obstruct walkways; or recordings do not disrupt others’ experience; consent is obtained where reasonable.

8. Operational Charges

As an indoor facility, play generally continues unaffected by weather. If an unforeseen issue disrupts play (e.g., power outage), the Club may reschedule or offer credits at its discretion.

9. Personal Belongings

The Club accepts no responsibility for lost or stolen property. Items found will be held for 14 days before disposal or donation.
